This website is intended for individuals who used Ontario’s COVID-19 vaccination management system, COVaxON, between January 1, 2015, and November 16, 2021. A class proceeding has been initiated by the plaintiff C.M. against the Ontario Government, Ayoub Sayid and Rahim Abdu, alleging negligence, breach of fiduciary duty, and other claims related to a significant data breach.

Nature of the Lawsuit
The lawsuit claims that the Ontario Government, Sayid and Abdu were negligent in safeguarding the personal and health information of patients within the COVaxON system. This negligence allegedly led to a data breach, resulting in the unauthorized access and use of sensitive patient information.
Summary of Allegations
The lawsuit alleges that sensitive personal and health information from the COVaxON system was accessed and used without authorization. It will be proven in this lawsuit that the government failed to implement proper cybersecurity measures, resulting in the data breach. The claim includes accusations of breaching privacy rights, failing to adhere to contractual obligations to protect patient information, and not providing timely and adequate notice about the breach. Additionally, the lawsuit alleges violations of the Personal Health Information Protection Act (PHIPA), the Personal Information Protection and Electronic Documents Act (PIPEDA), and the Canadian Charter of Rights and Freedoms.

The class includes all individuals whose personal and health information was included in the COVaxON system and was compromised in the breach.
